KITSULY TERMS OF SERVICE, SOFTWARE AND PLATFORM TERMS
Effective date: 20 /09 /2026
Last updated: 20 /09 /2026
These Terms of Service, Software and Platform Terms ("Terms") govern access to and use of Kitsuly, including the Kitsuly website, Kitsuly Commerce software, Kitsuly services, APIs, platform services, integrations, subscriptions, licences and associated products.
Kitsuly is operated by T1K1 Brands, ABN/ACN 89830337348, of Gold Coast QLD Australia ("Kitsuly", "we", "us" or "our").
By downloading, installing, activating, accessing, purchasing or using Kitsuly, you agree to these Terms.
If you use Kitsuly on behalf of a company, organisation or other entity, you confirm that you have authority to bind that entity to these Terms.
If you do not agree to these Terms, do not use the Kitsuly services.
1. About Kitsuly
Kitsuly is an ecommerce and website commerce platform designed primarily for WordPress.
Depending on the version, plan, configuration and connected services selected by a merchant, Kitsuly may provide functionality including:
- ecommerce storefront management;
- product and inventory management;
- physical, digital, variable, bundled and subscription products;
- customer accounts;
- shopping carts and checkout;
- payments;
- invoicing;
- shipping;
- tax configuration;
- bookings and services;
- subscriptions and licence management;
- order fulfilment;
- returns and refunds;
- discounts and promotions;
- email marketing;
- social publishing and scheduling;
- website analytics;
- SEO tools;
- artificial intelligence features;
- catalogue generation and migration;
- themes and visual design tools;
- integrations with external platforms;
- developer APIs and extensions; and
- other related merchant tools.
Features may differ between Kitsuly editions, versions, jurisdictions and connected third-party services.
2. WordPress.org Version and Open-Source Licence
The version of Kitsuly Commerce distributed through the official WordPress.org Plugin Directory is licensed under the licence stated in that plugin package, currently intended to be GNU General Public License v2 or later ("GPLv2+").
Nothing in these Terms is intended to remove, restrict or override any rights granted to you under the GPL in relation to code distributed under that licence.
These Terms separately govern matters such as:
- access to Kitsuly-hosted services;
- Kitsuly Platform Controller services;
- paid subscriptions;
- commercial licences;
- customer support;
- hosted APIs;
- social connection services;
- payment orchestration;
- cloud-based functionality;
- account services; and
- other services supplied separately from GPL-licensed plugin code.
Where these Terms conflict with rights expressly granted by the applicable open-source licence for particular software code, the applicable open-source licence governs that code.
WordPress.org requires directory plugins to use GPL-compatible licensing and allows genuine external SaaS functionality, while prohibiting locally included functionality from merely being locked behind payment. WordPress Developer Resources
3. Kitsuly Editions
Kitsuly may offer editions including:
- Free / Base;
- Pro;
- Business; and
- other editions or commercial offerings introduced in the future.
The current features, pricing, transaction rates and entitlements of each edition are those displayed by Kitsuly at the time of purchase or activation.
The WordPress.org edition is not intended to operate as a time-limited trial.
Paid editions may be supplied as separate commercial software packages or services outside WordPress.org.
4. Accounts
Some Kitsuly functionality can operate locally without a Kitsuly account.
Other functionality may require:
- a Kitsuly account;
- registration of the website;
- a Kitsuly installation identifier;
- a valid paid licence;
- connection to the Kitsuly Platform Controller;
- connection to a third-party provider; or
- authentication with another service.
You are responsible for:
- providing accurate account information;
- protecting your account credentials;
- maintaining control of authorised users;
- keeping administrator email addresses current; and
- notifying us promptly of suspected unauthorised access.
You are responsible for actions performed through your account unless caused by a failure for which Kitsuly is legally responsible.
5. Merchant Responsibility
If you use Kitsuly to operate a store, marketplace, booking service or other commercial website, you are the merchant responsible for your business and customers.
Kitsuly does not become the seller merely because Kitsuly software or infrastructure is used to facilitate a transaction.
Unless expressly stated otherwise, you remain responsible for:
- products and services you sell;
- product descriptions;
- pricing;
- customer service;
- fulfilment;
- shipping;
- refunds;
- returns;
- warranties;
- legal disclosures;
- tax registration;
- tax collection;
- consumer protection obligations;
- age restrictions;
- privacy notices;
- marketing consent;
- product safety;
- intellectual property rights; and
- compliance with laws applicable to your business.
6. Payments
Kitsuly may integrate with external payment processors, including Stripe and other supported providers.
Payment functionality may use the Kitsuly Platform Controller to perform services such as:
- account connection;
- payment orchestration;
- transaction processing;
- transaction-status reconciliation;
- platform fee handling;
- refunds;
- webhook processing;
- payment-method configuration; and
- related payment operations.
Payment-card information may be entered directly into payment-provider-controlled interfaces.
Kitsuly does not intend for merchants to store raw payment-card credentials inside WordPress.
Payment services remain subject to the rules, availability requirements, account eligibility and terms of the applicable payment provider.
Kitsuly cannot guarantee that every payment method will be available in every country, currency or merchant account.
7. Kitsuly Platform Transaction Fees
Certain Kitsuly editions may include a Kitsuly platform transaction fee.
The applicable rate will be displayed in:
- your plan information;
- Kitsuly;
- the purchase process;
- the relevant pricing page; or
- another disclosure provided before or during use of the applicable payment service.
Unless required otherwise by law, transaction fees are calculated on transactions processed under the applicable plan.
The Kitsuly platform fee is a commercial charge to the merchant and is not automatically represented to the merchant's customer as a separate customer surcharge.
A merchant must not attempt to:
- manipulate the active edition;
- falsify a licence entitlement;
- bypass platform-fee calculations;
- interfere with Controller authentication;
- modify payment requests to avoid fees; or
- misrepresent transaction data.
We may reconcile transaction-fee records where there is a processing discrepancy.
8. Refunds and Transaction Fees
A refund to a merchant's customer does not necessarily reverse fees already incurred in processing the original transaction.
Applicable payment-provider fees, Kitsuly transaction fees or refund-related processing charges may remain payable where disclosed and legally permitted.
Any specific refund-processing charge will be disclosed through the relevant Kitsuly plan, interface or commercial terms.
Nothing in this section limits rights that cannot lawfully be excluded.
9. Pro and Business Subscriptions
Kitsuly Pro, Business or other paid products may be offered as:
- an initial purchase;
- a recurring subscription;
- an annual renewal;
- another disclosed renewal period; or
- a combination of these.
The amount payable, renewal amount and renewal frequency will be shown before purchase.
Where automatic renewal is offered, its status must be disclosed during purchase.
You may disable automatic renewal through the available account controls where supported.
Disabling automatic renewal prevents future automatic renewal charges but does not ordinarily refund the current paid subscription period.
We will not intentionally continue charging for a subscription after valid cancellation contrary to applicable law.
Automatic-renewal terms should be transparent and should not remove rights protected by Australian consumer law. The ACCC has specifically identified opaque or unfair automatic renewal arrangements as potentially problematic. ACCC
10. Paid Licences and Domains
A paid Kitsuly licence may be issued for a specific number of production websites.
Unless your plan states otherwise:
one paid Kitsuly licence permits activation on one production domain.
For licence matching, Kitsuly may normalise technically equivalent forms of the same domain, including differences such as:
- http and https; and
- www and non-www.
A licence may be associated with:
- a licence key;
- plan;
- website/domain;
- expiry date;
- subscription;
- customer identity; and
- entitlement information.
You may request a legitimate domain change through the supported process.
You must not knowingly use one single-site licence simultaneously across unrelated production domains.
Development, staging or testing entitlements may be provided separately where expressly supported.
11. Licence Validation Service
Paid licence entitlements may be validated through a Kitsuly-operated licensing service.
Validation may transmit limited technical information necessary to determine entitlement, such as:
- licence key;
- installation identifier;
- domain;
- software version;
- plan; and
- licence status information.
Licence validation is used to verify access to commercial Kitsuly services and paid editions.
It does not change the open-source rights applicable to separately distributed GPL-licensed code.
12. Third-Party Services
Kitsuly may integrate with third-party services such as:
- Stripe;
- Meta / Facebook;
- Instagram;
- Pinterest;
- X;
- LinkedIn;
- TikTok;
- Google;
- OpenAI;
- Anthropic;
- Google Gemini;
- Australia Post;
- DHL;
- FedEx;
- UPS;
- Sendle;
- Shopify;
- BigCommerce; and
- other supported providers.
Connecting a service may result in data being transmitted to that provider.
Third-party services operate independently of Kitsuly and may:
- change their APIs;
- change their pricing;
- alter permissions;
- impose usage limits;
- discontinue functionality;
- require app review;
- restrict certain accounts;
- suspend access; or
- change their terms.
Kitsuly is not responsible for a third party's independent decisions or systems.
Use of a third-party service is also subject to that provider's own terms and privacy policy.
WordPress.org requires external services used by a plugin to be clearly disclosed, including when data is sent and links to the external provider's terms/privacy information. WordPress Developer Resources
13. Social Media Connections
Kitsuly may permit merchants to connect third-party social accounts using OAuth or similar account-authorisation mechanisms.
Supported platforms may include:
- Facebook;
- Instagram;
- Pinterest;
- X;
- LinkedIn;
- TikTok; and
- other supported services.
When connecting a social service, you authorise Kitsuly to perform only the operations permitted by:
1. the permissions you approve;
2. the provider's API;
3. your account type; and
4. the functionality provided by Kitsuly.
Examples may include:
- reading the connected account's basic identity;
- identifying Pages, profiles, boards or organisations available to you;
- publishing content;
- uploading media;
- retrieving publishing status; and
- maintaining the authorised connection.
14. Social Tokens and Credentials
Where Kitsuly provides central social account connections, social access tokens may be stored securely by Kitsuly-controlled server infrastructure rather than in the merchant's WordPress installation.
We may use reasonable encryption and access-control measures for stored credentials.
You may disconnect a connected social provider using the available controls.
Disconnecting a provider may revoke or delete the relevant Kitsuly connection record, although the provider may separately retain records in accordance with its own policies.
You should also revoke the application from the provider itself where you require immediate provider-side revocation.
15. Social Publishing and Scheduling
Kitsuly may allow content to be:
- composed centrally;
- adapted by platform;
- scheduled;
- published immediately;
- uploaded as media;
- retried after failure; or
- distributed to multiple connected platforms.
You remain responsible for all content you publish.
You must ensure that you have rights to use all:
- text;
- images;
- logos;
- photographs;
- videos;
- music;
- trademarks;
- product imagery; and
- other materials.
Kitsuly does not guarantee that a scheduled post will publish at an exact time where failure is caused by circumstances outside our reasonable control, including:
- third-party API outages;
- expired authorisation;
- provider rate limits;
- content rejection;
- network failures;
- account restrictions; or
- changes to platform requirements.
16. Artificial Intelligence
Kitsuly may include artificial-intelligence-assisted functionality.
AI functionality may be provided:
- locally;
- through Kitsuly infrastructure; or
- through external providers selected or configured by the merchant.
AI-generated content may include:
- product descriptions;
- marketing copy;
- SEO suggestions;
- social content;
- catalogue information;
- summaries;
- images;
- tags;
- categorisation; or
- recommendations.
AI output may be inaccurate, incomplete, inappropriate or unsuitable.
You must review AI-generated content before publishing or relying upon it.
Kitsuly does not warrant that AI output is:
- factually correct;
- legally compliant;
- free from third-party rights;
- unique;
- suitable for professional advice; or
- appropriate for your business.
You remain responsible for content you publish.
17. AI Provider Data
If you configure an external AI provider, data necessary to perform your request may be sent to that provider.
This may include:
- prompts;
- product descriptions;
- catalogue content;
- selected images;
- website content; or
- other information supplied to the AI function.
Do not intentionally submit confidential, sensitive or personal information to an AI provider unless you have a lawful basis to do so and understand that provider's terms.
18. Search Engine Optimisation
Kitsuly includes tools that may assist with:
- SEO titles;
- descriptions;
- schema;
- internal links;
- media metadata;
- sitemaps;
- Google Search Console;
- keyword information;
- audits; and
- performance recommendations.
Kitsuly does not guarantee:
- search-engine rankings;
- traffic;
- indexing;
- impressions;
- clicks;
- sales; or
- acceptance of structured data.
Search engines independently determine how websites are crawled, indexed and ranked.
19. Analytics
Kitsuly may provide first-party and external analytics.
Reported information may differ from other analytics platforms due to:
- data-processing rules;
- cookie restrictions;
- browser protections;
- ad blockers;
- sampling;
- timezones;
- attribution methods;
- delayed reporting; or
- external API limitations.
Analytics are informational tools and should not be treated as audited financial records unless expressly stated.
20. Shipping
Kitsuly may obtain shipping information or quotes from external carriers.
Rates and delivery estimates supplied by carriers may depend on information including:
- location;
- postcode;
- parcel dimensions;
- parcel weight;
- service class;
- declared options; and
- carrier account configuration.
The merchant is responsible for verifying shipping information before relying upon it.
Kitsuly does not control carrier delivery performance.
21. Taxes
Kitsuly may provide tax calculation, configuration and informational tools.
Kitsuly is not a tax adviser, accountant or tax authority.
Tax rates, thresholds, classifications and obligations vary.
Merchants are responsible for determining:
- whether they must register for tax;
- which jurisdictions apply;
- correct tax classification;
- filing obligations;
- exemptions;
- tax invoices;
- reporting; and
- payments to government authorities.
You should obtain professional advice where appropriate.
22. Bookings and Services
Kitsuly booking functionality may allow merchants to offer:
- appointments;
- accommodation;
- rentals;
- services;
- venues;
- resources; and
- other time-based products.
The merchant remains responsible for:
- availability;
- pricing;
- deposits;
- cancellation conditions;
- service delivery;
- safety requirements;
- licences;
- insurance;
- customer communications; and
- legal compliance.
Kitsuly does not itself become the provider of the merchant's booked service.
23. Digital Products
Kitsuly may provide protected digital delivery.
Features may include:
- private file storage;
- access entitlements;
- expiring download links;
- download limits;
- customer account access; and
- refund-based entitlement revocation.
You remain responsible for ensuring you have legal rights to distribute digital content.
No internet-access control system can guarantee that legitimately downloaded material will never be copied or redistributed.
24. Customer Data
A merchant may use Kitsuly to collect and process customer information.
Depending on enabled functionality this may include:
- names;
- email addresses;
- telephone numbers;
- addresses;
- order information;
- account information;
- booking information;
- returns;
- subscriptions;
- marketing preferences; and
- other transaction information.
As merchant, you are responsible for determining your own legal obligations in relation to customer data and providing required privacy notices.
25. Privacy
Our handling of personal information is also governed by the Kitsuly Privacy Policy.
The Privacy Policy forms part of the overall Kitsuly legal framework but is maintained separately so it can clearly explain:
- information collected;
- purposes of collection;
- storage;
- disclosures;
- overseas processing;
- third-party providers;
- cookies;
- analytics;
- access;
- correction;
- complaints; and
- retention.
Where the Australian Privacy Act applies, an APP entity must maintain a clearly expressed and current privacy policy covering matters including the information collected, how it is used and disclosed, access/correction procedures, complaints and likely overseas disclosure. OAIC
26. Email and Marketing
You must use Kitsuly's marketing functionality lawfully.
You must not use Kitsuly to:
- send spam;
- purchase or scrape unlawful mailing lists;
- impersonate another party;
- mislead recipients;
- evade unsubscribe requests; or
- send marketing communications without required permission.
You are responsible for compliance with applicable anti-spam, privacy and direct-marketing laws.
27. Content and Intellectual Property
You retain ownership of content you upload to Kitsuly.
You grant Kitsuly a limited licence to:
- host;
- copy;
- transmit;
- transform;
- resize;
- cache;
- process; and
- otherwise use
your content only to the extent reasonably necessary to provide the services you have requested.
This licence ends when the relevant content or service is deleted or terminated, except where retention is reasonably required for:
- backups;
- legal compliance;
- accounting;
- security;
- dispute resolution; or
- technical integrity.
28. Kitsuly Intellectual Property
Except for code or materials made available under open-source or third-party licences, Kitsuly retains all rights in its:
- trademarks;
- brand;
- logos;
- service infrastructure;
- documentation;
- designs;
- proprietary APIs;
- hosted services;
- websites; and
- other proprietary materials.
"Kitsuly" and associated branding may not be used in a manner that falsely implies affiliation, endorsement or ownership.
29. Prohibited Conduct
You must not use Kitsuly to:
- engage in illegal activity;
- distribute malware;
- compromise systems;
- steal credentials;
- violate intellectual property rights;
- commit fraud;
- facilitate deceptive transactions;
- circumvent payment fees;
- bypass licences;
- abuse APIs;
- interfere with service availability;
- send unlawful spam;
- impersonate another person;
- deliberately overload infrastructure;
- attempt unauthorised access;
- reverse engineer private authentication mechanisms for circumvention purposes;
- misuse customer information; or
- violate the terms of connected providers.
Legitimate exercise of rights granted under an applicable open-source licence is not prohibited by this section.
30. Security
We use reasonable technical and organisational measures intended to protect Kitsuly infrastructure.
However, no online service can guarantee absolute security.
You are responsible for maintaining:
- secure WordPress hosting;
- supported PHP and WordPress versions;
- secure passwords;
- administrator access control;
- backups;
- timely plugin updates; and
- reasonable site security.
You must notify us promptly if you discover a suspected security vulnerability affecting Kitsuly.
31. Updates
Kitsuly may release:
- bug fixes;
- security updates;
- compatibility updates;
- improvements;
- new features; or
- changed integrations.
Third-party platform changes may sometimes require functionality to be altered or discontinued.
Where reasonably practicable, we will attempt to preserve compatibility, but we cannot promise indefinite compatibility with every:
- WordPress release;
- WordPress theme;
- plugin;
- host;
- browser;
- third-party API; or
- external service.
32. Beta, Preview and Experimental Features
Some functionality may be marked:
- Beta;
- Preview;
- Experimental;
- Early Access; or
- similar.
These features may:
- change;
- be incomplete;
- contain defects;
- have additional limitations; or
- be withdrawn.
Do not rely on experimental features for critical business processes without appropriate safeguards.
33. Fable Demo
Kitsuly Fable is an interactive demonstration environment.
Unless expressly stated otherwise:
- information displayed in Fable is synthetic;
- transactions are not real;
- customers are fictional;
- analytics are simulated;
- payment actions do not represent live payments;
- connected services may be simulated; and
- the environment may reset automatically.
Fable is intended to demonstrate Kitsuly functionality, not operate a production store.
34. Support
Support availability may depend on the applicable Kitsuly edition.
Support does not include guaranteed:
- custom development;
- third-party debugging;
- server administration;
- tax advice;
- legal advice;
- accounting advice; or
- guaranteed resolution of third-party provider issues.
We may request diagnostic information reasonably necessary to investigate a support issue.
35. Availability
We aim to keep Kitsuly-hosted services reasonably available.
We do not promise uninterrupted or error-free availability.
Services may be unavailable due to:
- maintenance;
- infrastructure failure;
- network interruption;
- security incidents;
- third-party outages;
- API changes;
- force majeure;
- government action; or
- other events beyond reasonable control.
36. Suspension
We may suspend access to Kitsuly-hosted services where reasonably necessary to:
- address security threats;
- investigate fraud;
- prevent system abuse;
- respond to unlawful conduct;
- comply with law;
- prevent material harm;
- address unpaid amounts; or
- enforce material breaches of these Terms.
Where reasonably practicable, we will provide notice and an opportunity to remedy the issue.
We will not use suspension merely to remove consumer rights protected by law.
37. Termination
You may stop using Kitsuly at any time.
You may cancel paid services in accordance with the applicable subscription process.
Termination does not automatically eliminate:
- amounts already incurred;
- transaction charges already processed;
- statutory recordkeeping requirements; or
- rights and obligations that by their nature survive termination.
Where reasonably available, merchants should export important business information before terminating a hosted service.
38. Refunds for Kitsuly Purchases
Any voluntary Kitsuly refund policy is additional to rights provided by law.
Nothing in these Terms excludes rights or remedies that cannot legally be excluded.
Where a refund is legally required, Kitsuly will provide the remedy required by applicable law.
39. Australian Consumer Law
If you are an Australian consumer or otherwise entitled to protections under the Australian Consumer Law, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
Australian consumer guarantees apply automatically and cannot simply be removed by contract. ACCC
Where legally required, the applicable consumer guarantee wording and remedies will apply.
40. No Professional Advice
Kitsuly provides software and technology tools.
Information provided through Kitsuly concerning:
- taxation;
- SEO;
- business performance;
- legal documents;
- accounting;
- accessibility;
- compliance;
- marketing;
- privacy;
- security; or
- other business matters
is general information and is not a substitute for qualified professional advice.
41. Disclaimers
To the maximum extent permitted by law, Kitsuly is provided on an "as available" basis.
We do not guarantee that:
- every feature will suit every business;
- every third-party integration will remain available;
- a website will achieve particular sales;
- SEO will achieve particular rankings;
- marketing will produce particular results;
- AI output will be accurate;
- every plugin/theme combination will be compatible; or
- external providers will approve, process or maintain a merchant account.
Nothing in this section excludes guarantees that cannot legally be excluded.
42. Limitation of Liability
To the maximum extent permitted by law, and subject to any rights that cannot be excluded, Kitsuly will not be liable for indirect, incidental, consequential or special loss arising from use of Kitsuly, including loss of:
- anticipated profit;
- business opportunity;
- goodwill; or
- data
to the extent such exclusion is lawful.
Where liability cannot legally be excluded but may lawfully be limited, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms limits liability where doing so would be unlawful.
43. Your Indemnity
To the extent permitted by law, you agree to indemnify Kitsuly against third-party claims arising directly from:
- content you publish;
- products or services you sell;
- infringement caused by material you supplied;
- your unlawful use of Kitsuly; or
- your material breach of these Terms.
This indemnity does not apply to the extent a loss was caused by Kitsuly's own unlawful, negligent or wrongful conduct.
44. Changes to Pricing
We may change pricing for future purchases or renewal periods.
We will not retrospectively change the price of a completed purchase.
Where a recurring subscription price changes, we will provide notice as required by applicable law before the changed price becomes payable.
You may cancel automatic renewal before the new renewal where cancellation rights apply.
45. Changes to These Terms
We may update these Terms when reasonably necessary because of:
- new functionality;
- changes to law;
- security requirements;
- commercial changes;
- third-party provider requirements; or
- changes to our services.
The updated Terms will display a revised "Last updated" date.
Where a material change affects an existing paid service, we will provide reasonable notice where required.
46. Assignment
You may not transfer a paid Kitsuly account or commercial entitlement in a manner that defeats the applicable licence terms without our consent.
We may assign our rights and obligations as part of:
- corporate restructuring;
- merger;
- acquisition;
- sale of business; or
- transfer of the Kitsuly business,
provided this does not unlawfully reduce your rights.
47. Governing Law
These Terms are governed by the laws of [STATE/TERRITORY, AUSTRALIA] and applicable Commonwealth law.
You and Kitsuly submit to the courts with jurisdiction in [STATE/TERRITORY], subject to any mandatory consumer rights or jurisdictional protections that apply to you.
48. Dispute Resolution

- access to Kitsuly-hosted services;
- Kitsuly Platform Controller services;
- paid subscriptions;
- commercial licences;
- customer support;
- hosted APIs;
- social connection services;
- payment orchestration;
- cloud-based functionality;
- Free / Base;
- Pro;
- a Kitsuly account;
- registration of the website;
- a Kitsuly installation identifier;
- a valid paid licence;
- connection to the Kitsuly Platform Controller;
- connection to a third-party provider; or
- authentication with another service.
You are responsible for:
- providing accurate account information;
- protecting your account credentials;
- maintaining control of authorised users;
- products and services you sell;
- product descriptions;
- pricing;
- customer service;
- fulfilment;
- shipping;
- refunds;
- returns;
- warranties;
- legal disclosures;
- tax registration;
- tax collection;
- consumer protection obligations;
- age restrictions;
- privacy notices;
- marketing consent;
- product safety;
- intellectual property rights; and
- compliance with laws applicable to your business.
6. Payments
Kitsuly may integrate with external payment processors, including Stripe and other supported providers.
Payment functionality may use the Kitsuly Platform Controller to perform services such as:
- account connection;
- payment orchestration;
- transaction processing;
- transaction-status reconciliation;
- platform fee handling;
- refunds;
- webhook processing;
- your plan information;
- Kitsuly;
- the purchase process;
- manipulate the active edition;
- falsify a licence entitlement;
- bypass platform-fee calculations;
- interfere with Controller authentication;
- an initial purchase;
- a recurring subscription;
- an annual renewal;
- a licence key;
- plan;
- website/domain;
- expiry date;
- subscription;
- licence key;
- installation identifier;
- domain;
- software version;
- plan; and
- licence status information.
Licence validation is used to verify access to commercial Kitsuly services and paid editions.
It does not change the open-source rights applicable to separately distributed GPL-licensed code.
12. Third-Party Services
Kitsuly may integrate with third-party services such as:
- Stripe;
- Meta / Facebook;
- Instagram;
- Pinterest;
- X;
- LinkedIn;
- TikTok;
- Google;
- OpenAI;
- Anthropic;
- Google Gemini;
- Australia Post;
- DHL;
- FedEx;
- UPS;
- Sendle;
- Shopify;
- BigCommerce; and
- other supported providers.
Connecting a service may result in data being transmitted to that provider.
Third-party services operate independently of Kitsuly and may:
- change their APIs;
- change their pricing;
- alter permissions;
- impose usage limits;
- discontinue functionality;
- require app review;
- restrict certain accounts;
- Facebook;
- Instagram;
- Pinterest;
- X;
- LinkedIn;
- TikTok; and
- other supported services.
When connecting a social service, you authorise Kitsuly to perform only the operations permitted by:
1. the permissions you approve;
2. the provider's API;
3. your account type; and
4. the functionality provided by Kitsuly.
Examples may include:
- reading the connected account's basic identity;
- identifying Pages, profiles, boards or organisations available to you;
- publishing content;
- uploading media;
- composed centrally;
- adapted by platform;
- scheduled;
- published immediately;
- uploaded as media;
- retried after failure; or
- distributed to multiple connected platforms.
You remain responsible for all content you publish.
You must ensure that you have rights to use all:
- text;
- images;
- logos;
- photographs;
- videos;
- music;
- trademarks;
- product imagery; and
- other materials.
Kitsuly does not guarantee that a scheduled post will publish at an exact time where failure is caused by circumstances outside our reasonable control, including:
- third-party API outages;
- expired authorisation;
- provider rate limits;
- content rejection;
- network failures;
- account restrictions; or
- changes to platform requirements.
16. Artificial Intelligence
Kitsuly may include artificial-intelligence-assisted functionality.
AI functionality may be provided:
- locally;
- through Kitsuly infrastructure; or
- through external providers selected or configured by the merchant.
AI-generated content may include:
- product descriptions;
- marketing copy;
- SEO suggestions;
- social content;
- catalogue information;
- summaries;
- images;
- tags;
- categorisation; or
- recommendations.
AI output may be inaccurate, incomplete, inappropriate or unsuitable.
You must review AI-generated content before publishing or relying upon it.
Kitsuly does not warrant that AI output is:
- factually correct;
- legally compliant;
- free from third-party rights;
- unique;
- suitable for professional advice; or
- appropriate for your business.
You remain responsible for content you publish.
17. AI Provider Data
If you configure an external AI provider, data necessary to perform your request may be sent to that provider.
This may include:
- prompts;
- product descriptions;
- catalogue content;
- selected images;
- website content; or
- other information supplied to the AI function.
Do not intentionally submit confidential, sensitive or personal information to an AI provider unless you have a lawful basis to do so and understand that provider's terms.
18. Search Engine Optimisation
Kitsuly includes tools that may assist with:
- SEO titles;
- descriptions;
- schema;
- internal links;
- media metadata;
- sitemaps;
- Google Search Console;
- keyword information;
- audits; and
- performance recommendations.
Kitsuly does not guarantee:
- search-engine rankings;
- traffic;
- indexing;
- impressions;
- clicks;
- sales; or
- acceptance of structured data.
Search engines independently determine how websites are crawled, indexed and ranked.
19. Analytics
Kitsuly may provide first-party and external analytics.
Reported information may differ from other analytics platforms due to:
- data-processing rules;
- cookie restrictions;
- browser protections;
- ad blockers;
- sampling;
- timezones;
- attribution methods;
- location;
- postcode;
- parcel dimensions;
- parcel weight;
- service class;
- whether they must register for tax;
- which jurisdictions apply;
- correct tax classification;
- filing obligations;
- exemptions;
- tax invoices;
- reporting; and
- payments to government authorities.
You should obtain professional advice where appropriate.
22. Bookings and Services
Kitsuly booking functionality may allow merchants to offer:
- appointments;
- accommodation;
- rentals;
- services;
- venues;
- resources; and
- other time-based products.
The merchant remains responsible for:
- availability;
- pricing;
- deposits;
- cancellation conditions;
- service delivery;
- safety requirements;
- licences;
- insurance;
- customer communications; and
- legal compliance.
Kitsuly does not itself become the provider of the merchant's booked service.
23. Digital Products
Kitsuly may provide protected digital delivery.
Features may include:
- private file storage;
- access entitlements;
- expiring download links;
- download limits;
- names;
- email addresses;
- telephone numbers;
- addresses;
- order information;
- account information;
- booking information;
- returns;
- subscriptions;
- information collected;
- purposes of collection;
- storage;
- disclosures;
- overseas processing;
- third-party providers;
- cookies;
- analytics;
- access;
- correction;
- send spam;
- purchase or scrape unlawful mailing lists;
- impersonate another party;
- mislead recipients;
- host;
- copy;
- transmit;
- transform;
- resize;
- cache;
- process; and
- otherwise use
your content only to the extent reasonably necessary to provide the services you have requested.
This licence ends when the relevant content or service is deleted or terminated, except where retention is reasonably required for:
- backups;
- legal compliance;
- accounting;
- security;
- dispute resolution; or
- technical integrity.
28. Kitsuly Intellectual Property
Except for code or materials made available under open-source or third-party licences, Kitsuly retains all rights in its:
- trademarks;
- brand;
- logos;
- service infrastructure;
- documentation;
- designs;
- proprietary APIs;
- hosted services;
- websites; and
- other proprietary materials.
"Kitsuly" and associated branding may not be used in a manner that falsely implies affiliation, endorsement or ownership.
29. Prohibited Conduct
You must not use Kitsuly to:
- engage in illegal activity;
- distribute malware;
- compromise systems;
- steal credentials;
- violate intellectual property rights;
- commit fraud;
- facilitate deceptive transactions;
- circumvent payment fees;
- bypass licences;
- abuse APIs;
- interfere with service availability;
- send unlawful spam;
- impersonate another person;
- deliberately overload infrastructure;
- attempt unauthorised access;
- reverse engineer private authentication mechanisms for circumvention purposes;
- secure WordPress hosting;
- supported PHP and WordPress versions;
- secure passwords;
- administrator access control;
- backups;
- timely plugin updates; and
- reasonable site security.
You must notify us promptly if you discover a suspected security vulnerability affecting Kitsuly.
31. Updates
Kitsuly may release:
- bug fixes;
- security updates;
- compatibility updates;
- improvements;
- new features; or
- changed integrations.
Third-party platform changes may sometimes require functionality to be altered or discontinued.
Where reasonably practicable, we will attempt to preserve compatibility, but we cannot promise indefinite compatibility with every:
- WordPress release;
- WordPress theme;
- plugin;
- host;
- browser;
- third-party API; or
- external service.
32. Beta, Preview and Experimental Features
Some functionality may be marked:
- Beta;
- Preview;
- Experimental;
- Early Access; or
- similar.
These features may:
- change;
- be incomplete;
- contain defects;
- have additional limitations; or
- be withdrawn.
Do not rely on experimental features for critical business processes without appropriate safeguards.
33. Fable Demo
Kitsuly Fable is an interactive demonstration environment.
Unless expressly stated otherwise:
- information displayed in Fable is synthetic;
- transactions are not real;
- customers are fictional;
- analytics are simulated;
- payment actions do not represent live payments;
- connected services may be simulated; and
- the environment may reset automatically.
Fable is intended to demonstrate Kitsuly functionality, not operate a production store.
34. Support
Support availability may depend on the applicable Kitsuly edition.
Support does not include guaranteed:
- custom development;
- third-party debugging;
- server administration;
- tax advice;
- legal advice;
- maintenance;
- infrastructure failure;
- network interruption;
- security incidents;
- third-party outages;
- API changes;
- force majeure;
- government action; or
- other events beyond reasonable control.
36. Suspension
We may suspend access to Kitsuly-hosted services where reasonably necessary to:
- address security threats;
- investigate fraud;
- prevent system abuse;
- respond to unlawful conduct;
- comply with law;
- prevent material harm;
- amounts already incurred;
- transaction charges already processed;
- taxation;
- SEO;
- business performance;
- legal documents;
- accounting;
- accessibility;
- compliance;
- marketing;
- privacy;
- security; or
- other business matters
is general information and is not a substitute for qualified professional advice.
41. Disclaimers
To the maximum extent permitted by law, Kitsuly is provided on an "as available" basis.
We do not guarantee that:
- every feature will suit every business;
- every third-party integration will remain available;
- a website will achieve particular sales;
- SEO will achieve particular rankings;
- marketing will produce particular results;
- AI output will be accurate;
- anticipated profit;
- business opportunity;
- content you publish;
- products or services you sell;
- infringement caused by material you supplied;
- new functionality;
- changes to law;
- security requirements;
- commercial changes;
- corporate restructuring;
- merger;
- acquisition;
If a dispute arises, please contact us first so we can attempt to resolve it directly.

Nothing in this section prevents a person from exercising statutory rights or referring a matter to a regulator, tribunal or court where permitted.
49. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue to operate to the extent legally possible.
50. No Waiver
Failure to enforce a provision immediately does not constitute a permanent waiver of that provision.
51. Entire Agreement
These Terms, together with any applicable:
- Privacy Policy;
- pricing terms;
- subscription terms;

- integrations with external platforms;
- access to Kitsuly-hosted services;
- Kitsuly Platform Controller services;
- paid subscriptions;
- commercial licences;
- customer support;
- hosted APIs;
- social connection services;
- payment orchestration;
- cloud-based functionality;
- Free / Base;
- Pro;
- a Kitsuly account;
- registration of the website;
- a Kitsuly installation identifier;
- a valid paid licence;
- connection to the Kitsuly Platform Controller;
- connection to a third-party provider; or
- authentication with another service.
You are responsible for:
- providing accurate account information;
- protecting your account credentials;
- maintaining control of authorised users;
- products and services you sell;
- product descriptions;
- pricing;
- customer service;
- fulfilment;
- shipping;
- refunds;
- returns;
- warranties;
- legal disclosures;
- tax registration;
- tax collection;
- consumer protection obligations;
- age restrictions;
- privacy notices;
- marketing consent;
- product safety;
- intellectual property rights; and
- compliance with laws applicable to your business.
6. Payments
Kitsuly may integrate with external payment processors, including Stripe and other supported providers.
Payment functionality may use the Kitsuly Platform Controller to perform services such as:
- account connection;
- payment orchestration;
- transaction processing;
- transaction-status reconciliation;
- platform fee handling;
- refunds;
- webhook processing;
- your plan information;
- Kitsuly;
- the purchase process;
- manipulate the active edition;
- falsify a licence entitlement;
- bypass platform-fee calculations;
- interfere with Controller authentication;
- an initial purchase;
- a recurring subscription;
- an annual renewal;
- a licence key;
- plan;
- website/domain;
- expiry date;
- subscription;
- licence key;
- installation identifier;
- domain;
- software version;
- plan; and
- licence status information.
Licence validation is used to verify access to commercial Kitsuly services and paid editions.
It does not change the open-source rights applicable to separately distributed GPL-licensed code.
12. Third-Party Services
Kitsuly may integrate with third-party services such as:
- Stripe;
- Meta / Facebook;
- Instagram;
- Pinterest;
- X;
- LinkedIn;
- TikTok;
- Google;
- OpenAI;
- Anthropic;
- Google Gemini;
- Australia Post;
- DHL;
- FedEx;
- UPS;
- Sendle;
- Shopify;
- BigCommerce; and
- other supported providers.
Connecting a service may result in data being transmitted to that provider.
Third-party services operate independently of Kitsuly and may:
- change their APIs;
- change their pricing;
- alter permissions;
- impose usage limits;
- discontinue functionality;
- require app review;
- restrict certain accounts;
- Facebook;
- Instagram;
- Pinterest;
- X;
- LinkedIn;
- TikTok; and
- other supported services.
When connecting a social service, you authorise Kitsuly to perform only the operations permitted by:
1. the permissions you approve;
2. the provider's API;
3. your account type; and
4. the functionality provided by Kitsuly.
Examples may include:
- reading the connected account's basic identity;
- identifying Pages, profiles, boards or organisations available to you;
- publishing content;
- uploading media;
- composed centrally;
- adapted by platform;
- scheduled;
- published immediately;
- uploaded as media;
- retried after failure; or
- distributed to multiple connected platforms.
You remain responsible for all content you publish.
You must ensure that you have rights to use all:
- text;
- images;
- logos;
- photographs;
- videos;
- music;
- trademarks;
- product imagery; and
- other materials.
Kitsuly does not guarantee that a scheduled post will publish at an exact time where failure is caused by circumstances outside our reasonable control, including:
- third-party API outages;
- expired authorisation;
- provider rate limits;
- content rejection;
- network failures;
- account restrictions; or
- changes to platform requirements.
16. Artificial Intelligence
Kitsuly may include artificial-intelligence-assisted functionality.
AI functionality may be provided:
- locally;
- through Kitsuly infrastructure; or
- through external providers selected or configured by the merchant.
AI-generated content may include:
- product descriptions;
- marketing copy;
- SEO suggestions;
- social content;
- catalogue information;
- summaries;
- images;
- tags;
- categorisation; or
- recommendations.
AI output may be inaccurate, incomplete, inappropriate or unsuitable.
You must review AI-generated content before publishing or relying upon it.
Kitsuly does not warrant that AI output is:
- factually correct;
- legally compliant;
- free from third-party rights;
- unique;
- suitable for professional advice; or
- appropriate for your business.
You remain responsible for content you publish.
17. AI Provider Data
If you configure an external AI provider, data necessary to perform your request may be sent to that provider.
This may include:
- prompts;
- product descriptions;
- catalogue content;
- selected images;
- website content; or
- other information supplied to the AI function.
Do not intentionally submit confidential, sensitive or personal information to an AI provider unless you have a lawful basis to do so and understand that provider's terms.
18. Search Engine Optimisation
Kitsuly includes tools that may assist with:
- SEO titles;
- descriptions;
- schema;
- internal links;
- media metadata;
- sitemaps;
- Google Search Console;
- keyword information;
- audits; and
- performance recommendations.
Kitsuly does not guarantee:
- search-engine rankings;
- traffic;
- indexing;
- impressions;
- clicks;
- sales; or
- acceptance of structured data.
Search engines independently determine how websites are crawled, indexed and ranked.
19. Analytics
Kitsuly may provide first-party and external analytics.
Reported information may differ from other analytics platforms due to:
- data-processing rules;
- cookie restrictions;
- browser protections;
- ad blockers;
- sampling;
- timezones;
- attribution methods;
- location;
- postcode;
- parcel dimensions;
- parcel weight;
- service class;
- whether they must register for tax;
- which jurisdictions apply;
- correct tax classification;
- filing obligations;
- exemptions;
- tax invoices;
- reporting; and
- payments to government authorities.
You should obtain professional advice where appropriate.
22. Bookings and Services
Kitsuly booking functionality may allow merchants to offer:
- appointments;
- accommodation;
- rentals;
- services;
- venues;
- resources; and
- other time-based products.
The merchant remains responsible for:
- availability;
- pricing;
- deposits;
- cancellation conditions;
- service delivery;
- safety requirements;
- licences;
- insurance;
- customer communications; and
- legal compliance.
Kitsuly does not itself become the provider of the merchant's booked service.
23. Digital Products
Kitsuly may provide protected digital delivery.
Features may include:
- private file storage;
- access entitlements;
- expiring download links;
- download limits;
- names;
- email addresses;
- telephone numbers;
- addresses;
- order information;
- account information;
- booking information;
- returns;
- subscriptions;
- information collected;
- purposes of collection;
- storage;
- disclosures;
- overseas processing;
- third-party providers;
- cookies;
- analytics;
- access;
- correction;
- send spam;
- purchase or scrape unlawful mailing lists;
- impersonate another party;
- mislead recipients;
- host;
- copy;
- transmit;
- transform;
- resize;
- cache;
- process; and
- otherwise use
your content only to the extent reasonably necessary to provide the services you have requested.
This licence ends when the relevant content or service is deleted or terminated, except where retention is reasonably required for:
- backups;
- legal compliance;
- accounting;
- security;
- dispute resolution; or
- technical integrity.
28. Kitsuly Intellectual Property
Except for code or materials made available under open-source or third-party licences, Kitsuly retains all rights in its:
- trademarks;
- brand;
- logos;
- service infrastructure;
- documentation;
- designs;
- proprietary APIs;
- hosted services;
- websites; and
- other proprietary materials.
"Kitsuly" and associated branding may not be used in a manner that falsely implies affiliation, endorsement or ownership.
29. Prohibited Conduct
You must not use Kitsuly to:
- engage in illegal activity;
- distribute malware;
- compromise systems;
- steal credentials;
- violate intellectual property rights;
- commit fraud;
- facilitate deceptive transactions;
- circumvent payment fees;
- bypass licences;
- abuse APIs;
- interfere with service availability;
- send unlawful spam;
- impersonate another person;
- deliberately overload infrastructure;
- attempt unauthorised access;
- reverse engineer private authentication mechanisms for circumvention purposes;
- secure WordPress hosting;
- supported PHP and WordPress versions;
- secure passwords;
- administrator access control;
- backups;
- timely plugin updates; and
- reasonable site security.
You must notify us promptly if you discover a suspected security vulnerability affecting Kitsuly.
31. Updates
Kitsuly may release:
- bug fixes;
- security updates;
- compatibility updates;
- improvements;
- new features; or
- changed integrations.
Third-party platform changes may sometimes require functionality to be altered or discontinued.
Where reasonably practicable, we will attempt to preserve compatibility, but we cannot promise indefinite compatibility with every:
- WordPress release;
- WordPress theme;
- plugin;
- host;
- browser;
- third-party API; or
- external service.
32. Beta, Preview and Experimental Features
Some functionality may be marked:
- Beta;
- Preview;
- Experimental;
- Early Access; or
- similar.
These features may:
- change;
- be incomplete;
- contain defects;
- have additional limitations; or
- be withdrawn.
Do not rely on experimental features for critical business processes without appropriate safeguards.
33. Fable Demo
Kitsuly Fable is an interactive demonstration environment.
Unless expressly stated otherwise:
- information displayed in Fable is synthetic;
- transactions are not real;
- customers are fictional;
- analytics are simulated;
- payment actions do not represent live payments;
- connected services may be simulated; and
- the environment may reset automatically.
Fable is intended to demonstrate Kitsuly functionality, not operate a production store.
34. Support
Support availability may depend on the applicable Kitsuly edition.
Support does not include guaranteed:
- custom development;
- third-party debugging;
- server administration;
- tax advice;
- legal advice;
- maintenance;
- infrastructure failure;
- network interruption;
- security incidents;
- third-party outages;
- API changes;
- force majeure;
- government action; or
- other events beyond reasonable control.
36. Suspension
We may suspend access to Kitsuly-hosted services where reasonably necessary to:
- address security threats;
- investigate fraud;
- prevent system abuse;
- respond to unlawful conduct;
- comply with law;
- prevent material harm;
- amounts already incurred;
- transaction charges already processed;

41. Disclaimers
To the maximum extent permitted by law, Kitsuly is provided on an "as available" basis.
We do not guarantee that:
- every feature will suit every business;

- a website will achieve particular sales;
- SEO will achieve particular rankings;
- marketing will produce particular results;
- AI output will be accurate;
- every plugin/theme combination will be compatible; or

Nothing in this section excludes guarantees that cannot legally be excluded.
42. Limitation of Liability
To the maximum extent permitted by law, and subject to any rights that cannot be excluded, Kitsuly will not be liable for indirect, incidental, consequential or special loss arising from use of Kitsuly, including loss of:
- anticipated profit;
- business opportunity;
- content you publish;
- products or services you sell;
- infringement caused by material you supplied;
- new functionality;
- changes to law;
- security requirements;
- commercial changes;
- corporate restructuring;
- merger;
- acquisition;
